Everett Can't Bar Acella From Linking Vitamins In Databases

Law360, Los Angeles (August 29, 2013, 8:50 PM EDT) -- A New Jersey federal judge on Thursday shot down Everett Laboratories Inc.’s requests for three injunctions prohibiting rival Acella Pharmaceuticals LLC from linking itself to Everett's prenatal vitamins in drug databases, saying Everett’s claim on four separate patents wasn’t inherently valid.

U.S. District Judge Joseph E. Irenas found Everett’s claims that its patents for three prenatal vitamins weren’t unquestionably enforceable. Everett was seeking the injunctions to keep Acella from piggybacking on Everett’s marketing by associating itself with Everett’s vitamins in drug databases.
