Texas Justices Expand Appellate Review Of New Trial Orders

Law360, Dallas (August 30, 2013, 8:40 PM EDT) -- The Texas Supreme Court said Friday that appellate courts have the power to review the substance of a trial judge’s order for a new trial, in a case that found a trial judge abused his discretion by striking the jury verdict in a vehicle rollover case against a Toyota Motors Co. unit.

The decision builds on a 2009 ruling, In re: Columbia Medical Center of Las Colinas, that required trial courts to issue written explanations of their reasons for granting a motion for a new trial....
