Hain Celestial Faces Beefed-Up Food Mislabeling Action

Law360, New York (August 30, 2013, 4:51 PM EDT) -- A California consumer lodged a revised suit in federal court on Friday accusing health food mainstay The Hain Celestial Group Inc. of misleading consumers, expanding state-level mislabeling claims to firm up a complaint tossed earlier this month.

Named plaintiff Suzanne Smedt responded to U.S. District Judge Edward A. Davila’s Aug. 16 dismissal of the suit with an amended complaint that dropped claims for consumer restitution based on unjust enrichment and breach of express warranties under the California Song-Beverly Act and federal Magnuson-Moss Warranty Act.
