Ex-Enron Broadband CFO Gets Conviction Tossed

Law360, New York (February 12, 2008, 12:00 AM EST) -- A federal appeals court has upheld a lower court’s decision to vacate the conviction of the former chief financial officer for Enron Corp.’s broadband unit on one count for manipulating records and to grant him a new trial.

The U.S. Court of Appeals for the Fifth Circuit on Tuesday reasoned that a jury could have based its conviction of Kevin Howard on that count on a conspiracy charge against him and on evidence that the false entries could have been made by a co-conspirator.
