9th Circ. OKs Class Deal, $13M Fee Award In Nvidia GPU Suit

Law360, Los Angeles (September 6, 2013, 4:51 PM EDT) -- The Ninth Circuit affirmed a district judge's approval of the settlement and $13 million in attorneys' fees in a consolidated class action accusing Nvidia Corp. of making defective graphic processing units that caused their computers to malfunction, ruling Wednesday that the deal was fair.

The appellate court said customers who object to the settlement can opt out of it to preserve their claims, and moreover, the deal allows them to pursue relief through other litigation.
