ICANN Not Immune To Antitrust Suits, 9th Circ. Hears

Law360, New York (September 10, 2013, 6:40 PM EDT) -- A top-level domain name applicant told the Ninth Circuit on Monday that the Internet Corporation for Assigned Names and Numbers should not be given antitrust immunity from its trademark and antitrust suit alleging a monopoly in the domain name market.

In its opening brief to the appeals court, name.space Inc. said a California federal judge was wrong to rule that ICANN — a private company that manages the Internet's system of identifiers such as .com, .net and .inc — had its monopoly power “thrust upon it”...
