Chinese Magnesite Cos. Say Standing Sinks Antitrust Suit

Law360, New York (September 10, 2013, 6:27 PM EDT) -- A group of foreign producers of magnesite told a New Jersey federal judge Monday that a proposed class action brought by two buyers over an alleged price-fixing cartel should be dismissed for lack of standing, while the purchasers defended their right to bring the claims.

The seven China-based magnesite suppliers told the court that one of the plaintiffs, Resco Products Inc., inherited its direct-purchaser claims from a U.S.-based broker of the allegedly overpriced transactions, yet there was no evidence the broker had actually bought the product...
