Oreck Customers Seek To Lift Ch. 11 Stay For False Ad Suit

Law360, New York (September 16, 2013, 12:11 PM EDT) -- A putative class of about 200,000 customers on Friday asked a bankruptcy judge in Tennessee to lift the automatic stay granted to Oreck Corp. so the class could pursue claims for alleged false advertising over a vacuum’s ability to purify the air of germs.

The plaintiffs say that Oreck falsely advertised that its Halo vacuum and three of its air purifiers could reduce the risk of flu and eliminate common germs and allergens, but Oreck is currently protected from the action by an automatic stay imposed...
