Labor Dept. Extends ERISA Benefits To Same-Sex Spouses

Law360, New York (September 18, 2013, 5:17 PM EDT) -- The U.S. Department of Labor on Wednesday issued new guidance clarifying that benefits under the Employee Retirement Income Security Act will be available to same-sex couples in light of the U.S. Supreme Court's landmark ruling that struck down a key provision of the Defense of Marriage Act.

The department's Employee Benefits Security Administration said that ERISA benefits will be extended to same-sex couples who were married in one of the 13 states that currently recognizes same-sex marriage, regardless of their current state of residence.
