Disney Skates on Enviros' Polluted Stormwater Claims

Law360, Los Angeles (September 25, 2013, 9:46 PM EDT) -- A California federal judge on Monday threw out part of a suit alleging Clean Water Act violations against Walt Disney Co., finding the federal stormwater program does not apply to pollutants discharged from the storm system at its Burbank, Calif., production facility.

U.S. District Judge Dolly M. Gee agreed with Disney that it was not required to obtain a National Pollutant Discharge Elimination System permit for its stormwater discharges because movie production is not an “industrial activity” under the Clean Water Act.
