Ex-Wal-Mart Worker Asks High Court To Revive ERISA Suit

Law360, New York (September 24, 2013, 6:54 PM EDT) -- An ex-worker of Wal-Mart Stores Inc. told the Supreme Court last week that the limitations period for filing an Employee Retirement Income Security Act suit over a denied disability benefits claim cannot begin until that case can be filed in court. 

Julie Heimeshoff's reply brief urged the nation's highest court to reverse a Sept. 2012 Second Circuit decision that affirmed the dismissal of her ERISA suit against Wal-Mart and Hartford Life & Accident Insurance Co. over the insurer's denial of her claim for long-term disability benefits....
