State Ordered To Pay Opponents' Fees In Atlantic Yards Row

Law360, New York (September 26, 2013, 6:50 PM EDT) -- A New York state judge on Wednesday ruled that Empire State Development Corp. must pay the attorneys' fees of the community groups that challenged parts of the $4.9 billion Atlantic Yards development in Brooklyn after they won a new environmental study for part of the project.

Judge Marcy Friedman ordered ESDC to pay an as-yet-undetermined amount of attorneys' fees accrued by Develop Don't Destroy Brooklyn Inc. and Prospect Heights Neighborhood Development Council Inc., which seek more than $320,000 in fees. The judge disagreed with the agency's...
