Hair Products Buyer Always Planned To Sue, Aveda Says

Law360, New York (September 26, 2013, 1:12 PM EDT) -- Salon company Aveda Corp. told a California judge on Wednesday that a “professional” plaintiff had feigned her use of its hair loss prevention products to engineer a false advertising class action, and asked for an order of dismissal.

Minnesota-based Aveda lodged a brief charging that plaintiff Rivkie Berger’s own pleadings indicate she bought its Invati product line March 7 and couldn’t have possibly used the products for the prescribed 12-week period before making moves to file a lawsuit.
