EU Court Clears 8 Countries Over Travel Tax Scheme

Law360, New York (September 26, 2013, 7:32 PM EDT) -- The European Court of Justice ruled Thursday that a special value-added tax scheme that governs travel agents' sales to travelers applies to all kinds of travel customers, like tour operators, squashing challenges that the European Commission brought against eight EU countries, including Spain.

The European Commission argued that the special scheme only applies to travel services sold to travelers, but the court noted that some language versions of the scheme use the word “traveler” and others use the word “customer,” creating discrepancies that must be analyzed...
