Promoter's Antitrust Suit Against NCAA Tossed By Ky. Judge

Law360, New York (September 27, 2013, 1:09 PM EDT) -- A Kentucky federal judge on Thursday tossed an antitrust suit brought against the NCAA by a promoter of middle and high school basketball tournaments, finding that the NCAA recruiting bylaw central to the case was not commercial in nature.

The court found that just because Bleid Sports LLC sustained economic losses as a result of the NCAA's decision that hosting the tournaments at its member schools could violate its recruiting rules, the rule itself is not commercial and therefore immune to a federal antitrust action....
