3rd Circ. Says Ex-Pa. Sen. Can't Delay Corruption Trial

Law360, Philadelphia (September 30, 2013, 5:11 PM EDT) -- The Third Circuit on Monday dismissed a bid by former Pennsylvania State Sen. Raphael Musto to indefinitely push back his criminal trial involving allegations he took bribes in exchange for help obtaining construction projects, finding it lacked jurisdiction to do so.

The appeals court rejected Musto’s arguments that the trial would violate his Sixth Amendment rights, concluding that he has failed to demonstrate that he would be incapable of assisting counsel in his defense.
