Office Depot To Settle Class Action Over OT Calculations

Law360, New York (October 10, 2013, 6:32 PM EDT) -- A worker accusing Office Depot Inc. of failing to factor bonus payments from an incentive program into the calculation of workers' regular rate of pay when determining overtime asked a California federal judge on Tuesday to bless his class action settlement with the retailer.

U.S. District Judge Susan Illston granted preliminary approval to the $350,000 deal in June, and the plaintiff filed a motion seeking final approval on Tuesday.

“The settlement in this case, reached after lengthy and hard fought litigation, is fair, adequate and reasonable,” the motion said.
