Saks' Preemptive Strike Torpedoes OT Collective Action

Law360, New York (October 9, 2013, 4:35 PM EDT) -- A California federal judge not only refused to certify a class of managers in an overtime suit against Saks Fifth Avenue Inc., but also granted Saks' preemptive bid to deny approval of a nationwide collective action, ruling last week that the putative class members' experiences were too varied.
