NYC's E-Hail Taxi Program Sidesteps Rulemaking, Atty Says

Law360, New York (October 9, 2013, 6:11 PM EDT) -- New York City's so-called "pilot program" to allow passengers to hail yellow taxis with smartphone apps is actually an attempt to elude rules prohibiting discrimination in street pickups, an attorney for rival livery car groups told a state appeals court Wednesday.

Randy M. Mastro of Gibson Dunn & Crutcher LLP, who represents the livery cab companies, told a four-judge panel Wednesday that a lower court's April decision allowing the pilot program to continue should be overturned because the program was a fig leaf for the NYC...
