Weight Watchers Trounces Ice Cream Calories Class Action

Law360, Los Angeles (October 17, 2013, 8:59 PM EDT) -- A New Jersey federal judge on Thursday dismissed a putative class action brought by Weight Watchers International Inc. consumers who say some of the company’s diet foods are deceptively labeled, ruling the customers haven’t rigorously tested the calorie counts on those foods.

U.S. District Judge William J. Martini rejected the consumers’ tests showing that Weight Watchers diet ice cream bars had upwards of 20 percent more calories than listed on the label, saying they didn't meet the standards outlined in the Food, Drug and Cosmetic Act....
