Calif. High Court Sends Employer Arbitration Suit Back To Trial

Law360, Los Angeles (October 17, 2013, 10:22 PM EDT) -- The California Supreme Court partially backpedaled on a February 2011 ruling Thursday, finding that a U.S. Supreme Court decision triggered the reversal of a California law that allows employees to take wage disputes to the labor commissioner before entering arbitration.

In the ruling, the court booted a 2007 dispute between an auto dealer and its former employee back to trial court, ordering the lower court to determine whether forcing the employee into arbitration would unfairly or unconscionably favor the car dealer. The suit stems from an...
