Insurer Fights For 6th Circ. To Rehear Indians Fan Death Suit

Law360, New York (October 21, 2013, 10:37 PM EDT) -- The Sixth Circuit ruling that found CSI Insurance Group might be liable for the damages incurred by the Cleveland Indians Baseball Company LP after a spectator was killed at a pregame event improperly expands Michigan state law, the insurer said in a brief Friday.

Fighting to have the full Sixth Circuit rehear CSI's case, the insurance company argues that the appellate panel's August ruling was an impermissible expansion of Michigan law because the decision provided a new basis of liability for third-party insureds.
