Ace Tells 6th Circ. Call Recordings Not Covered If Secret

Law360, New York (October 22, 2013, 1:50 PM EDT) -- Ace Property & Casualty Insurance Co. asked the Sixth Circuit on Monday to revoke defense coverage that customer services provider Convergys Corp. won for two telephone recording class actions, saying alleged wiretapping alone doesn't implicate its policy.

The insurer is disputing its duty to defend Convergys subsidiaries Encore Receivable Management Inc. and Convergys Customer Management Group Inc. against two California lawsuits alleging illegal recording of calls made to Hyundai Motor Corp. customer service lines they managed.
