EU Says Dutch Energy Unbundling Law May Pass Muster

Law360, New York (October 22, 2013, 8:06 PM EDT) -- The European Union's highest court ruled Tuesday that Dutch laws requiring the unbundling of electric and natural gas providers and barring private investment in energy distribution system operators did not necessarily violate the bloc's rules.

The European Court of Justice reasoned that the Netherlands could pass those kinds of laws that restrict the free movement of capital if it has overriding reasons that are in the public interest and said it was up to the Netherlands' Supreme Court to decide if the Dutch government's efforts passed...
