Wyndham Accused Of Stiffing Sales Reps On OT Pay

Law360, Washington (October 23, 2013, 4:45 PM EDT) -- Two Wyndham Worldwide Inc. units were hit with a proposed class action in Tennessee federal court Wednesday, accusing them of requiring sales representatives to work off the clock to avoid paying overtime.

According to plaintiffs Jesse Pierce and Michael Pierce, the Wyndham units have violated the Fair Labor Standards Act by forcing their sales staff to clock out but continue working, as well getting supervisory staff to "shave" hours worked by sales reps in its time-keeping system, in order to avoid paying overtime.
