NLRB's DR Horton Dooms Honda Dealer's Arbitration Policy

Law360, New York (October 24, 2013, 4:10 PM EDT) -- A National Labor Relations Board judge ruled Wednesday that a California Honda dealership's mandatory arbitration agreement policy ran afoul of federal labor law under the board's 2012 D.R. Horton Inc. ruling, even though the dealership itself has moved to consolidate individual arbitrations brought by its employees.

Administrative Law Judge Eleanor Laws ruled that although Concord Honda's mandatory arbitration policy does not contain an explicit class waiver, it uses singular language that could be construed by employees as permitting individual arbitration actions only.
