Texas High Court Urged To Toss Tax Incentive Defamation Suit

Law360, Houston (October 24, 2013, 8:01 PM EDT) -- A Corpus Christi newspaper owned by E.W. Scripps Co. asked the Texas Supreme Court on Wednesday to ax a suit by a businessman who claims the paper defamed him after he questioned a $40 million tax incentive to build a shopping mall.

The Corpus Christi Caller Times argued in a brief filed with the high court that former Corpus Christi Chamber of Commerce CEO Terry Carter had not shown the paper acted with “actual malice” when it ran a series of articles criticizing his job performance....
