High Court Green-Lights Age Bias Suit Against FedEx

Law360, New York (February 27, 2008, 12:00 AM EST) -- The U.S. Supreme Court has ruled that employees who allege job discrimination should not be penalized because the Equal Employment Opportunity Commission has not adequately investigated their claims.

In a 7-2 decision on Wednesday, the Supreme Court cleared the way for an age discrimination case to move forward against Federal Express Corp.

Justice Anthony Kennedy, who spoke for the majority, took the EEOC to task for failing to inform the Memphis, Tenn.-based delivery company that 14 employees had filed a complaint alleging age discrimination.
