Ill. Court Allows Extrinsic Evidence In Ruling Against Insurer

Law360, New York (November 1, 2013, 3:19 PM EDT) -- After examining an underlying complaint as well as third-party complaints, a state appeals court ordered Illinois Emcasco Insurance Co. to defend Waukegan Steel Sales Inc. against an injury suit brought by a subcontractor's employee, according to a decision posted online Wednesday.

The appeals court held on Sept. 13 that Emcasco owed coverage for a lawsuit brought by John Walls, an employee of Waukegan's subcontractor who was injured while working on a high school construction site. Walls claimed that Waukegan failed to provide a safe workplace and that it did not perform reasonable inspections.
