5th Circ. To Rehear Texas Bingo Law Challenge En Banc

Law360, Houston (October 31, 2013, 5:43 PM EDT) -- The Fifth Circuit said in an opinion released Thursday that the full court will reconsider whether a Texas law that prevents charities from spending money raised through bingo games on political lobbying is a valid restriction on government subsidization of political speech.

The appeals court granted a petition for rehearing en banc filed by a group of more than a dozen charities that say the Texas Bingo Enabling Act, which allows qualifying organizations to raise money for charitable causes but blocks them from spending the money...
