7th Circ. Revives Don, Doff Suit Against ThyssenKrupp

Law360, Los Angeles (October 31, 2013, 6:57 PM EDT) -- The Seventh Circuit on Thursday revived a Fair Labor Standards Act lawsuit against ThyssenKrupp Waupaca Inc. by iron foundry employees who argue they should be paid overtime for time spent showering and changing clothes, saying the district court ignored a factual dispute about the health effects of chemical exposure at the factories.

In a 2-1 ruling, the appellate panel reversed U.S. District Judge William C. Griesbach's ruling granting summary judgment to ThyssenKrupp, concluding the district judge erred in ruling that the donning-and-doffing activities weren't compensable work...
