UnitedHealth Shakes Mental Health Coverage Suit

Law360, New York (November 1, 2013, 4:48 PM EDT) -- UnitedHealth Group Inc. on Thursday defeated a proposed class action accusing the insurer of denying mental health treatment to consumers with severe behavioral disorders who had employer-sponsored health plans.

U.S. District Judge Colleen McMahon granted UnitedHealth’s June motion to dismiss the Employee Retirement Income Security Act suit, finding that some of the plaintiffs in the suit are wrongly trying to hold UnitedHealth responsible for ERISA violations when they have not alleged that it is the plan administrator.
