Benihana Says Chef's FLSA Action Lacks Facts

Law360, New York (November 7, 2013, 5:09 PM EST) -- Private equity-owned Japanese restaurant chain Benihana urged a Florida federal judge Wednesday to throw out a collective action brought by a former chef accusing the restaurant of unlawfully deducting tips from chefs and not paying overtime, saying the plaintiff did not allege enough facts to prove his claims.
