CIT Backs Commerce's Duty Findings On Thai Plastic Bags

Law360, New York (November 13, 2013, 4:10 PM EST) -- The U.S. Court of International Trade on Wednesday affirmed a decision by the U.S. Department of Commerce that kept anti-dumping duties on imports of plastic bags from Thailand, rejecting arguments from both the Thai respondents and U.S. producers faulting the department's review methodology.

In a 25-page opinion, CIT Chief Judge Donald Pogue said the department correctly adhered to the court's instructions when its initial duty review findings were remanded earlier this year.
