2nd Circ. Douses Starbucks Fight Against 'Charbucks'
Law360, New York (November 15, 2013, 3:42 PM EST) -- The Second Circuit on Friday gave coffee giant Starbucks Corp. yet another defeat in its 12-year trademark row with a small New England coffee roaster over a “Charbucks”-branded coffee blend that Starbucks contends dilutes its own trademark.
Affirming a New York court's earlier decision, the Second Circuit said that Starbucks had failed to prove a likelihood that New Hampshire-based Wolfe’s Borough Coffee Inc.’s “Charbucks” coffee blend would dilute the Starbucks brand, according to an opinion. The appeals court said a federal judge had been correct in ruling that the dispute did not trigger a violation of the Trademark Dilution Revision Act...
