Phone Users Lose Class Cert. Bid In Text Service Suit

Law360, New York (November 19, 2013, 1:57 PM EST) -- Cellphone users accusing certain text message service providers of fraudulently enrolling them in monthly subscription plans failed Monday to convince a California federal judge to certify consumers in the suit when he found that the plaintiffs did not sufficiently show all proposed class members had not agreed to such subscriptions.
