Phone Users Lose Class Cert. Bid In Text Service Suit

Law360, New York (November 19, 2013, 1:57 PM EST) -- Cellphone users accusing certain text message service providers of fraudulently enrolling them in monthly subscription plans failed Monday to convince a California federal judge to certify consumers in the suit when he found that the plaintiffs did not sufficiently show all proposed class members had not agreed to such subscriptions.

U.S. District Judge William Alsup denied the plaintiffs' motion to certify three classes of consumers, finding that with regards to at least one of those classes — the so called text receipt class — the plaintiffs...
