Bodum 'Shop-In-Shop' Suit Against JC Penney Sent To Texas

Law360, New York (November 21, 2013, 5:54 PM EST) -- A New York state judge on Thursday sent French press manufacturer Bodum to J.C. Penney Co. Inc.'s home turf in Texas to litigate allegations that the retailer abandoned a promise to build customized Bodum boutiques in its stores like those it had planned for Martha Stewart.

After a hearing in Manhattan, Judge Shirely Werner Kornreich dismissed the suit in favor of Texas, where the retailer is headquartered and whose courts were the agreed-upon venue to litigate any disputes that arose from agreements between the two companies....
