2nd Circ. Won't Ditch Stop-And-Frisk Rulings Yet

Law360, New York (November 22, 2013, 4:12 PM EST) -- The Second Circuit may have removed the judge who ruled in two class actions that New York City’s stop-and-frisk policy violated the rights of minorities, but the appeals court refused Friday to toss those decisions on that basis alone.

In a five-page opinion, the appeals panel denied the city’s motion to vacate the two decisions by U.S. District Judge Shira A. Scheindlin, who was pulled from the cases last month after the Second Circuit questioned her impartiality and froze the implementation of her rulings.
