DC Comics Soars To Victory In Superman Rights Suit

Law360, Los Angeles (November 22, 2013, 5:54 PM EST) -- The heirs of Superman co-creator Joseph Shuster made a valid deal with DC Comics in 1992 that gave up their rights to reclaim their stake in the iconic character, a Ninth Circuit panel said Thursday, handing DC its latest victory in the battle over Superman’s copyright.

A 2-1 majority ruled that the 1992 agreement prevented Shuster’s estate from terminating its copyright grants, as it had tried to do in 2003. Copyright law allows for termination notices for copyrights assigned before 1978, and Shuster’s heirs had argued...
