AUO Loses Bid to Move Circuit City Antitrust Claims To Va.

Law360, San Francisco (November 22, 2013, 4:41 PM EST) -- A California federal judge Friday tossed AU Optronics Corp.'s bid to move to Virginia a Circuit City Stores Inc. trustee's state-law claims over price-fixing on LCD panels, saying she wasn't convinced that the bankrupt retailer's Virginia headquarters should control which state's laws apply.

U.S. District Court Judge Susan Illston quickly denied AUO's choice-of-law argument, saying that existing case law — including case law developed in the sprawling multidistrict litigation of which the AUO-Circuit City spat is a part — clearly says that California law can control...
