1st Circ. Seeks Top Mass. Court's Take On Foreclosure Laws

Law360, New York (November 25, 2013, 6:31 PM EST) -- The First Circuit on Friday asked the Massachusetts Supreme Judicial Court to weigh in on a group of banks’ appeal of a decision allowing the city of Springfield to implement anti-foreclosure ordinances, saying the issues in the case turn on unresolved state law questions.

In December 2011, Springfield, in an effort to regulate the increasing number of residential property foreclosures and prevent safety hazards presented by abandoned houses, passed two ordinances designed to mitigate the problem. Six local banks challenged the laws in state court, but...
