EFF Takes Surveillance FOIA Fight To DC Circ.

Law360, Washington (November 26, 2013, 6:32 PM EST) -- The Electronic Frontier Foundation on Tuesday asked the D.C. Circuit to reverse a lower court’s dismissal of its Freedom of Information Act suit seeking a document containing the DOJ's legal advice to the FBI on a now-discontinued telephone surveillance program.

EFF counsel Mark T. Rumold argued before a three-judge panel that the advice given by the U.S. Department of Justice’s Office of Legal Counsel in this instance was a controlling interpretation of law subject to the FOIA.
