Macy's Customer Loses 'Shop And Frisk' Class Cert. Bid

Law360, New York (December 4, 2013, 5:04 PM EST) -- A New York City woman who claims Macy's Inc. falsely accused her of shoplifting cannot convert her case into a class action because such incidents, which have attracted the attention of state law enforcement officials, differ too widely from each other, a state judge ruled Wednesday.

During a hearing in Manhattan, Judge Anil C. Singh said that the allegations of Ayla Gursoy — a Turkish woman who claims she was falsely accused of shoplifting because of her ethnicity — involve different individual circumstances than other cases....
