Stryker Fax Recipients Win Class Cert. In TCPA Suit

Law360, New York (December 11, 2013, 3:31 PM EST) -- A Michigan federal judge on Wednesday granted class certification to recipients of Stryker Corp. faxes promoting orthopedics seminars, advancing a Cincinnati medical practice’s claims that the device maker’s faxes violated the Telephone Consumer Protection Act by not including an opt-out notice.

U.S. District Judge Robert J. Jonker granted Physicians Healthsource Inc.’s motion for certification in a case accusing Stryker of sending more than 15,000 fax blasts promoting orthopedic technology seminars to more than 8,000 numbers stored by the American Medical Association.
