Oil Driller's Trespass Case To Get Texas High Court Review

Law360, Dallas (December 13, 2013, 6:08 PM EST) -- The Texas Supreme Court on Friday agreed to hear an oil producer’s argument that it shouldn’t be held liable for trespass after using a roadway across land subject to a pooling agreement to service its wells.

Key Operating & Equipment Inc. contends the First Court of Appeals wrongly applied the accommodation doctrine to find landowners Will and Loree Hegar had a valid trespass claim against the company’s use of the roadway, which it built before the Hegars purchased the land and built their home there.
