Indian Harbor Sued Over Medicare Whistleblower Coverage

Law360, New York (January 2, 2014, 5:43 PM EST) -- Two affiliated mobile diagnostic imaging providers have lodged a lawsuit in California court, accusing Indian Harbor Insurance Co. of sidestepping its duty to cover a pair of underlying employee whistleblower suits that allege they operated referral-kickback schemes and fleeced Medicare.

Symphony Diagnostic Services No. 1 Inc., better known as Mobilex, and Kan-Di-Ki LLC sued along with their mutual parent company after the insurer allegedly disclaimed coverage under a policy spanning the 2010-2012 period for an ongoing Ohio federal suit accusing Mobilex of False Claims Act violations....
