Ill. Nursing Home Challenges $9M FCA Verdict Before 7th Circ.

Law360, Chicago (January 9, 2014, 5:06 PM EST) -- An Illinois nursing home on Thursday pressed the Seventh Circuit to overturn a $9 million False Claims Act judgment against it, arguing that the whistleblowers failed to link allegations of substandard care and other regulatory violations to actual fraudulent claims submitted to the government.

At a hearing before the appeals court in Chicago, Momence Meadows Nursing Center Inc. argued that its regulatory violations were extensively detailed in government surveys, thus prohibiting the claims under the FCA’s public disclosure bar.
