DOL Wants Frito-Lay Suit Remanded Over OFCCP Mistake

Law360, New York (January 8, 2014, 7:33 PM EST) -- Frito-Lay Inc.'s lawsuit challenging an information request made during a discrimination probe by the Office of Federal Contract Compliance Programs should be remanded to the U.S. Department of Labor to address an OFCCP mistake, the DOL told a Dallas federal court Tuesday. 

Plano, Texas-based Frito-Lay, a federal contractor, sued the DOL in June 2012, arguing that a May 8 order by the DOL Administrative Review Board directing the snack maker to comply with the data request was arbitrary and capricious and ran afoul of the U.S. Constitution....
