Feds Won't Appeal Ruling On Ex-Pa. Sen's Fitness For Trial

Law360, Philadelphia (January 9, 2014, 3:13 PM EST) -- Prosecutors will not appeal a ruling finding that a former Pennsylvania state senator facing corruption charges for allegedly taking bribes to help obtain grants for construction projects was mentally unfit for trial, U.S. Attorney Peter Smith announced Wednesday.

U.S. District Judge A. Richard Caputo on Tuesday granted 84-year-old Raphael Musto’s request for an indefinite continuance on mental health grounds, while rejecting claims that his physical condition placed obstacles to a trial.
