9th Circ. Says NetLogix Spoiled Evidence In T-Mobile Suit

Law360, New York (January 9, 2014, 5:18 PM EST) -- The Ninth Circuit ruled Thursday that a lower court properly dismissed NetLogix’s breach-of-contract suit alleging T-Mobile USA Inc. failed to pay NetLogix for engineering and technical work on its 3G network, after finding that NetLogix destroyed and fabricated evidence.

A three-judge panel of the Ninth Circuit held that U.S. District Judge Ricardo S. Martinez in the Western District of Washington properly tossed the suit in March 2012 as a sanction for NetLogix allowing its employees to destroy engineering notebooks and failing to preserve a Web-based database...
